Article 2: Application of these terms and conditions:

The general conditions thus presented apply to all purchases made from VInico on its online shop via the website www.vinico.be or by phone. To know the conditions of his order, the customer can click at any moment, even before making an order, on “Terms of Sale”.

The fact of placing an order implies full and unrestricted adherence of the customer to the different clauses presented in these terms and conditions. Only a written agreement stipulating between the two parts of the special conditions can be accepted, otherwise the conditions thus presented are automatically subject to the existing contractual relations between the Client and the Vinico company.

The offers presented by Vinico are reserved for private customers and legal persons types companies, groups, wine shops or restaurant under certain conditions.

The customer declares before validation of his order to have accepted these terms and conditions and consequently, to adhere to it entirely.

 

Article 3: Ordering modality:

All orders are made on the website www.vinico.be.

The customer builds a cart by choosing the number of products he wants. Once selected, the customer validates his basket and his method of payment.

After accepting the terms and conditions, the orders become final when they are validated by the payment of the products.

Vinico has the right to require from the customer proof of identity and domicile (and intra-community VAT number for legal persons) to validate the order. In case of refusal by the customer or nonconformity of the parts, Vinico can refuse and cancel the order. For its part if the customer does not want to submit to this control, it can cancel the order.

The Verification Department is also entitled to cancel certain orders if it considers that the latter presents different anomalies and irregularities.

An invoice is issued by Vinico and sent to the customer by email, or to his billing address. An order confirmation is sent by email.

In accordance with the terms of the law of July 11, 2013, relating to the retention of title, the products remain the property of Vinico until full payment of invoices.

The customer becomes the owner and responsible for the items upon delivery, the transfer of possession being transfer of risk.

 

Article 4: Methods of payment and prices:

A: Payment methods:

The payment of the products can be made by cash (in point of sale), bank transfer, credit cards, gift cards.

Bank cards :

Cards with the logo CB, VISA, MASTERCARD or AMERICAN EXPRESS are accepted.

Bank transfer :

Vinico only accepts gift cards issued by Vinico.

B- Prices :

For Belgium, the prices are expressed in Euros (€) and displayed all taxes included (Belgian VAT and all other applicable taxes). For the other countries of the European Union, the price differs according to the country of delivery of the product and will take into account the local VAT of the country of consumption and other taxes (excise duties).

The price indicated on the product sheets is indicated excluding transport costs. On the same product the price may vary depending on the quantities chosen. The shipping cost varies depending on the delivery method chosen by the customer and depending on the country of delivery.

The company Vinico reserves the right to modify its selling prices.

All promotional activities (vouchers, coupons, partner discounts …) are limited to one person per household per operation. Vinico reserves the right to refuse orders that do not meet this criterion.

 

Article 5 : Delivery :

National delivery : Upon receipt of payment of the order, Vinico initiates the transport and delivery operations. Delivery of the items ordered is made to the address provided by the customer. The delivery information indicated by the customer commits it. In case of error or lack of information leading to a defect or absence of delivery, the company Vinico will not be held responsible. In case of return for incomplete address, the customer will have the possibility either to change his address and to be reshipped the goods by supporting the new return costs, or to be reimbursed the order deduction of initial shipping costs.

Community delivery : Regarding the customer wishing to be delivered in an EU country mentioned in the list of countries delivered, in the same way as a national delivery, Vinico company is responsible for the routing of its products.

Responsibility for transportation : It is the customer’s responsibility to check the contents of the package at the time of receipt and to make reservations if necessary, as follows: on the delivery bill provided by the carrier or by immediately calling the customer service of the carrier, in the presence of the deliveryman. And, in any case, by warning the company Vinico by LETTER RECOMMENDED addressed to its address of correspondence within 2 days after reception of the package AND by mail to: info@vinico.be .

Deadlines: The company Vinico undertakes to make every effort to deliver the products ordered as soon as possible. Delivery times vary depending on the product, the delivery method chosen and the country of destination of the goods. If in the order, the products have different delivery times, it is the longest delivery time that applies to the entire order.

 

Article 6: Stock and out of stock:

In case of out of stock on a product ordered, Vinico undertakes to keep informed as soon as possible and will propose to its client various alternatives:

  • The replacement of the product out of stock by a product equivalent or superior quality under the same tariff conditions.
  • The refund of the unavailable product (s) or the totality of the order according to the choice of the customer.

In the case of a temporary out of stock, the customer will be offered the choice to wait until the date of replenishment that will be indicated. The customer will have the opportunity to accept and wait to receive the entire order, request partial or full cancellation of his order.

 

Article 7 : Commercial Operations and Benefits :

All promotional offers on www.vinico.be and commercial transactions such as sales (winter and summer) are subject to special conditions. Indeed, these operations can commit over a period, on a stock limit, availability, quantity. At the end of the offer, the products are likely to change prices. As a result, the customer takes advantage of this offer over a period of time and once it has expired, Vinico can not commit to offer the same benefits to the customer on another future order.

 

Article 8 :  Right of withdrawal :

Conditions

You have the right to withdraw from this contract without giving any reason within fourteen days.

The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, physically takes possession of the property.

To exercise this right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous declaration (for example, letter sent by post or email).

In order for the withdrawal period to be respected, it is sufficient that you transmit your communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

Retraction effects

If you withdraw from this contract, we will reimburse you for all payments received from you, including delivery charges (with the exception of additional charges arising from the fact that you have chosen, if other than the cheapest standard delivery method we offer) without undue delay and, in any event, no later than fourteen days from the day we are informed of your decision to withdraw from this contract.
We will refund using the same means of payment as you used for the original transaction, unless you expressly agree otherwise, in any event, this refund will not result in any costs to you. We may defer repayment until we have received the goods or until you have provided proof of shipment of the goods, whichever is the earlier.

You must return the good personally or send it back to Vinico – 208a Cité Vandervelde – 7134 Ressaix without undue delay and, in any event, no later than fourteen days after you give us your decision to withdraw from this contract. . This period is considered respected if you return the good before the expiration of the period of fourteen days.

You will be responsible for the direct costs of returning the property.

Your liability is only incurred with respect to the depreciation of the good resulting from manipulations other than those necessary to establish the nature, the characteristics and the good functioning of this good. In the event that certain products have been started or consumed, Vinico will be entitled to deduct these products from the refund made to the buyer.

Article 9 : Applicable law and dispute resolution :

Amicable settlement of disputes between the professional and the consumer.

In case of unresolved dispute between the Professional and the Consumer, the consumer has the possibility to seize the mediator of consumption.
Before entering the mediator of consumption, the consumer must have already tried to resolve the dispute directly with the professional by a written complaint or have made a claim under the terms of the contract with the professional.

The mediation of consumption is an out-of-court settlement of consumer disputes.

If the conditions are right, a mediation of consumption will take place according to a precise process and according to the texts in force.

The mediation will be done online, on the platform belmed.be.

Important : Never send defective, contentious or reimbursement items to the consumer mediator.
Never send the original documents to the consumer ombudsman.

Applicable law and Jurisdiction

These terms and conditions of sale are governed by Belgian law. If any of the clauses of these conditions prove null and void, this will affect neither the validity nor the respect of the present conditions. In the event of persistent disagreement concerning these conditions and in the absence of an amicable agreement, any dispute will fall under the competent Belgian courts.

Refund deadlines

In the event of a refund following a dispute, we will reimburse you the amount agreed upon with our customer service without undue delay and no later than fourteen days from the day you have agreed in writing with our customer service. In the event of a refund in exchange for a return of merchandise, we may defer the refund until we have received the merchandise or until you have provided proof of shipment of the merchandise in return, the date this is the first of these facts. For credit card refunds, note that interbank delays can delay the actual credit on your account by a few days.
